Secretary-general Fran- cis Atwoli (right) has asked Parliament to immediately review the legislation, saying it is the only way to protect the National Social Security Fund. MPs passed the Act in December before taking the long Christmas recess and the President assented to it on December 24. The commencement date for its implementation was pushed from January 10 to May 31. Cotu said this gave the government room to push through decisions without the input from the two groups’ representatives. The Act, in its present form, says two thirds of members of the Board of Trustees form a quorum, without specifying the composition of representation. A section of MPs lobbied for the removal of a rider in the Bill that was presented to Parliament that provided that representatives of the Federation of Kenya Employers (FKE) and Cotu must be present to form a quorum by virtue of their membership. The provision was meant to safeguard the interests of the two groups. FKE and Cotu have two members each on the board, whose membership also includes the Treasury and Labour and Social Welfare principal secretaries . The fear is that the govern- ment can easily get a simple majority to form a quorum and endorse resolutions that can impact negatively on the workers’ fund, including allowing avenues for its looting. Speaking at a meeting with Date in December last year when President assented to NSSF Act the Public Investments Committee yesterday, Mr Atwoli warned that workers’ funds would easily end up in wrong places if the current Act was executed to the letter.
